Terms

Article 1 (Purpose of the Agreement)

The purpose of this agreement is to stipulate the rights, duties and responsibilities of both MintPot and its members and the conditions and procedure for using the services ("Services") provided by MintPot ("MintPot").

 

Article 2 (Definitions of the Terms)

 ① The definitions of the terms used in this agreement are as follows.

1. A “member” is the person who gets registered as a member by providing his or her personal information to MintPot. Members can continuously use the services provided by MintPot.

2. An “account (ID)” is the combination of letters and numbers which are selected by members and approved by MintPot for the identification of members and the use of services.

3. A “password” is the combination of letters and numbers selected by members for the confirmation of their membership in accordance with the accounts given to them and the protection of their rights and interests.

4. A “post” is any writing, photo, video, file or link posted by members in terms of services for using those services.

5. A “nickname” is the name selected by members and used on MintPot.

② For any term not defined in this agreement, it is required to follow the agreement or guide for each service or the rules stipulated by the related laws. For any other matter, it is necessary to follow the general customs.

 

Article 3 (Effect of the Agreement)

① MintPot posts the contents of this agreement on the initial service screen (the whole page) in order to help members to easily become aware of them. However, it is possible to enable members to see the contents of this agreement through a linked screen.

② MintPot can establish a separate user's agreement for each service. When there is any conflict between the contents of the separate user's agreement and those of this agreement, the separate user's agreement must be applied first.

③ Even if a certain article cannot be applied, it does not influence other articles.

④ For any matter not specified in this agreement and the separate user's agreement, it is required to follow the related laws. For anything not specified in the related laws, it is necessary to follow the customs.

 

Article 4 (Alteration of the Agreement)

① MintPot can alter this agreement as long as the alteration does not violate the related laws for the improvement and efficient operation of services.

② When the agreement is altered, MintPot must specify the application date and the reason for the alteration, while posting them on the service homepage and the notice of the app together with the current agreement in advance within 7 days before the application date. However, when any content of the agreement is altered negatively against members, it is required to make a notice by having more than 30 days of stay period in advance. In such a case, MintPot must clearly compare the contents before and after the amendment and indicate any change for members' clear understanding.

③ MintPot must help members to recognize the alteration of the agreement by getting members' approval for the altered agreement at the time of their first log-in after the application date of the agreement.

④ When any member does not agree with the altered agreement, he or she must withdraw from his or her membership.

 

Article 5 (Membership)

① The membership process is done when the user's application for membership and the approval by MintPot for the membership process are completed. The membership process is completed when the approval by MintPot reaches the user applying for membership.

② Users apply for membership by indicating their intention to agree with this agreement after providing their information for membership according to the application form set by MintPot.

③ MintPot can request a specialized agency to confirm applicants' real names and certify their identities for membership. In any case which is thought to be necessary by MintPot, it is possible to request the submission of separate documents.

④ When applying for or changing membership, members must accurately complete the information form. They must not use others' names or register false information.

⑤ Users must not apply for any account subject to one of the following provisions for the application of their membership.

1. Any antisocial or custom-violating account or nickname

2. Any account or nickname that can cause a misunderstanding for being the administrator of MintPot

3. Any account or nickname that can cause concerns for the exposure of one's personal information

⑥ In principle, MintPot approves every user's application for membership. However, in any of the following cases, it is possible to suspend the approval for membership.

1. When there is no realistic space for the service-related facilities

2. When there is any technical or work-related problem for providing services

3. When it is required to submit separate data other than the application form for membership

4. Any other case required by MintPot

⑦ In any of the following cases, MintPot can refuse the user's application for membership.

1. When the rules related to the user's application for membership are not followed

2. When anyone loses his or her qualification for membership based on Clause 1 of Article 6 (However, the case of getting the approval by MintPot for the re-application of membership is excluded.)

⑧ When the user's application for membership is suspended or refused, MintPot must notify the applicant of the reason for such a decision.

 

Article 6 (User's Limitation & Withdrawal)

① In any of the following cases, MintPot can limit members' using services or terminate their membership.

1. When members violate their duties specified in the related laws, this agreement or any separate service agreement or fail to follow policies, user's guide or notices

2. When members impersonating the executives of MintPot or anyone concerned

3. When members do not log in the app continuously for more than 6 months

4. When members get access to the app by using approaches other than those authorized by MintPot

5. When members cause an excessive load to the service facilities regardless of their intention

6. When members carry out any illegal or unjust action

② When members carry out the actions subject to Clause 5 and Clause 6 of Provision 1, MintPot can block the subject members' access to services separately from the measure applied based on Provision 1.

③ When limiting members' using services or terminating their membership, MintPot must notify the subject members of such a decision. The members receiving such a notice can file an objection within 30 days from the day when they receive the notice from MintPot.

④ Members can request the withdrawal of their membership at any time through the service homepage or the app. When there is a request for the withdrawal of membership, MintPot must immediately process the request according to the related laws.

 

Article 7 (Management of Accounts & Passwords)

① Members must manage their own accounts and passwords.

② Members must not let others know about their accounts and passwords. When they become aware that their accounts and passwords are used by someone else, they must immediately change their passwords. Also, they must report the case to MintPot and follow the guide provided by MintPot.

③ In terms of the previous provision, if the subject members do not report the case to MintPot or follow the guide provided by MintPot after reporting it, they must bear all the related harms by themselves.

④ Members must log themselves out clearly after finishing using members' services. If they experience harms caused by their not logging themselves out clearly, they must bear them by themselves.

⑤ For such reasons as the security and account policies and the active provision of services, MintPot can demand the alteration of members' accounts and passwords or alter them by itself.

 

 

Article 8 (Management & Protection of Members' Information)

① Members' personal information can be read or corrected only by the members themselves. Such information is managed entirely based on the members' accounts and passwords.

② For the management and protection of their personal information, members can read or correct such information at any time through the management screen for personal information. However, it is impossible to correct the accounts or real names which are required for the management of services.

③ When their personal information managed by MintPot is altered, members must immediately correct it. They must bear all the harms caused by them not correcting their personal information.

④ MintPot tries to protect the members’ personal information. For the protection and use of personal information, the related laws and the personal information processing policy are applied. However, in any of the linked sites other than the official site of MintPot, the personal information processing policy of MintPot is not applied.

⑤ For the protection of other members’ personal information, members must not carry out any of the following actions.

1. The action of using services in an unjust way by using other members’ accounts and passwords

2. The action of collecting, storing and revealing other members’ personal information without their approval

 

Article 9 (Offering & Administration of Services)

① MintPot executes the following works.

1. Offering of VR or 2D contents within MintPot

2. Execution of various activities to support members to utilize the services of the MintPot app

3. Execution of other works set by MintPot

In order to provide stable services continuously, MintPot tries its best. For such a purpose, MintPot must sincerely maintain, inspect and recover its services.

In principle, services can be used for 24 hours a day throughout the year. However, by dividing services into specific segments based on their characteristics, it is possible to set the time for using each segment separately. In such a case, the contents are posted in advance.

According to its policy for members, MintPot classifies members into different grades and applies different ways of using services based on such subdivided segments as the time and the frequency for using services and the functions of services.

 

Article 10 (Suspension of the Services)

MintPot can temporarily suspend the services subject to each of the following provisions for the optimal operation of services.

1. When it is required to inspect, repair or replace the facilities

2. When there is any technical error influencing the process of providing services

3. When a new service is added

4. When there is any need related to the work or technique of MintPot

Also, regardless of the intention of MintPot, services can be interrupted due to the following reasons. In such cases, MintPot must make it possible to resume the services quickly.

1. When telecommunication services are suspended by the key telecommunication service provider without any separate notice

2. When too many members use services or there is any error related to the facilities

3. When there is any national state of emergency, natural disaster or equivalent force majeure state

When there is any plan to suspend services, MintPot must notify members of the reason and the period for the suspension. However, when there is any reason that makes it impossible for MintPot to provide a notice in advance, it is possible for MintPot to make the notice later.

 

Article 11 (Alteration & Abolition of the Services)

When there is any operational or technical need, MintPot can abolish services or alter them as follows.

1. Addition, alteration or removal of functions

2. Addition or removal of the limitations for using services

3. Other altered points related to services

When altering or terminating services, the reasons, contents and application dates must be posted in advance.

Regardless of Provision 2, when a new version or function is provided for the software applied to services, the software can be updated automatically.

 

Article 12 (Offering & Notice of the Information)

MintPot can provide various kinds of information admitted to be necessary by members for using services to the members through notices, bulletin boards and e-mail.

Members can refuse the reception of the information delivered through such personal media as e-mail at any time.

When providing notices to members, MintPot must basically use the in-service notices. In a special case, it is possible to provide notices to members by e-mail.

 

Article 13 (Use of the Services)

Members must not misuse services. They must use them rightly. For using services, the following actions must not be executed.

1. Any action interrupting the business of MintPot

2. Any intentional or accidental action violating the normal operation of services

3. Any action adapting or re-engineering the software provided by MintPot

4. Any action using services with the goal of making profits without the approval of MintPot

5. Any action using services with the goal of damaging public interests in the society

6. Any action interrupting other members’ using services

7. Any action damaging the honour of MintPot and any third party involved or brining harms to them

② Members cannot make a deal with others for the related rights or their statuses specified in the user’s agreement to others or transfer or give such rights or statues to others. Also, such rights and statuses cannot be used as securities.

③ Members can bring forward any opinion or complaint related to the use of services. When such an opinion or complaint is admitted to be just, MintPot must process it quickly. Also, MintPot must notify members of the handling process and result for the opinion or complaint.

 

Article 14 (Management of the Posts)

Members must register their posts accurately and rightly. They are responsible for the credibility or accuracy of the information or data which they post.

Members are entirely responsible for the civil or criminal charge that could occur due to their violating others’ copyrights with their posts.

In the following cases, members must not make posts. If the contents of the posts are subject to the following cases, it is possible to delete the posts without a prior notice.

1. When the post violates the national safety or security

2. When the post includes the contents related to elections or any political purpose or trend

3. When the post criticizes any specific organization, group or department with no evidence

4. When the post speaks ill of a particular person or damages his or her honour

5. When the post is a commercial ad with the goal of making profits

6. When the post violates copyrights

7. When the post contains such unhealthy contents as swear words and pornography

8. When the post contains practices, jokes or errors

9. When the post violates other related laws

 

Article 15 (Copyright)

① All the copyrights and other rights related to the software, images, marks, names and information used in services belong to MintPot. Members only have the right to use services based on the user’s terms set by MintPot.

② Members must not imitate or steal the services and brand of MintPot.

③ The copyrights of the posts made by members in the services belong to the copyright holders of the subject posts.

④ Members cannot copy, reproduce, modify, translate, publish, broadcast or use the information obtained by using services in any other way or provide it to others without a prior consent.

⑤ Members must not violate such intellectual property rights as the copyrights of MintPot and the third party.

 

Article 16 (Compensation for Damage)

① For any damage which occurs due to the violation of the copyright-related duty mentioned in Article 15 by members, MintPot can ask the subject members for compensation.

② When members violate their duties stipulated in this agreement, MintPot can ask them for compensation based on the related laws.

 

Article 17 (Exemption)

① When it is impossible to provide services based on the force majeure reasons mentioned in Provision 2 of Article 10, MintPot is exempted from the responsibility for providing services.

② When there is any merchandise or financial transaction between members or a member and the third party by using the services as a medium, MintPot is not responsible for it.

③ MintPot is not responsible for any profit expected by members for using services. Also, MintPot is not responsible for any loss experienced by members for the services provided free of charge except for the cases of intentionally-executed criminal activities.

④ MintPot is not responsible for any profit or loss obtained by members based on posts or replies.

⑤ MintPot is not responsible for the deletion or the transfer failure of posts due to the operational problems as long as they are not intentional ones.

 

Article 18 (Paid Contents Policy)

① Members can purchase paid contents by utilizing the Google billing system or the inner billing system of MintPot.

② Basically, the purchased contents cannot be returned. However, if the inner services of MintPot are not active, it is possible to return them and get a refund in MintPot points.

③ It is possible to cancel any subscription or monthly self-clearing product within MintPot at any time based on the members’ will. It is necessary to provide a notice about products separately in advance. Members are fully responsible for the use of the subject products.

④ MintPot can apply fees to members for using services based on the established price policy.

 

Article 19 (Refund Policy)

○ ① In any of the following cases, it is the standard of judgement which is the inner services of MintPot are not active. it can be only the reason of refund.

1. When the purchased content is not able to watch for over 7 days because of the inner services of MintPot are not active

2. When the purchased content is different from the content for trying to buy because of the inner services of MintPot are not active

3. When the purchased content is not able to watch because of the termination of the contract with the content providers, the changes of media rating of each countries.

4. When the purchased content is not able to watch because of the charging system change of MintPot

○ ② When the inner services of MintPot are not active, it is possible to return the purchased content within 3 days to only MintPot points.

○ ③ the standard of returned point is the points at the time of purchase. it is 70% refund if it is the refund within 30 days, 50% refund if it is the refund within 180 days, 30% refund if it is after 180 days. the refund way is only for MintPot points.

 

Article 20(Competent Court)

① When there is any conflict between MintPot and its members regarding the use of services, both MintPot and its members must try their best to solve it in harmony.

② When a lawsuit is brought up in regard to the conflict occurred due to the use of services regardless of the previous provision, the court that has jurisdiction over the location of the headquarters of MintPot is chosen to be the competent one.

 

<Supplementary Provision>

① This policy is enforced since July 1st, 2016.
